The rules for using AI-Tourguide

CRITICAL SAFETY NOTICE

You are solely responsible for your safety.

AI-Tourguide provides AI-generated stories, suggestions, and walking directions. The AI is not physically present at your location and cannot assess real-world conditions such as traffic, weather, construction, closed or dangerous areas, or the accessibility of a route for you personally. Always use your own judgment before following any suggestion or direction, and never follow guidance that appears unsafe.

1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of the AI-Tourguide website at ai-tourguide.net and the AI-Tourguide web app at ai-tourguide.net/guide (together, the "Service"), operated by AIchievable, Daniel Gerlach, Riedmattstrasse 3b, 6030 Ebikon, Switzerland ("we", "us"). The Service runs in your web browser — there is no app to download or install. By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

You must be at least 13 years old (16 in the EU/EEA) to use the Service. If you use the Service on behalf of an organization, you confirm that you are authorized to bind that organization.

If you use the Service as a consumer, nothing in these Terms limits any rights you have under mandatory consumer protection law.

2. The Service

AI-Tourguide is an interactive AI tour guide for self-guided city walks. You can generate a personal tour for any city and theme, or start one of our curated tours. During a tour, two things run side by side: a map with your route and waypoints, and an AI guide that speaks with you — it tells stories about the places on your route, asks and answers questions, and adapts to the conversation. You choose the route, pace, and breaks yourself; the AI does not control navigation.

The Service requires an internet connection and a reasonably modern browser, and it needs your browser permissions (such as microphone and location) only for the features that use them.

When using the Service, you must:

4. AI Limitations

The guide's responses are generated by artificial intelligence. AI-generated content can be incorrect, outdated, or invented ("hallucinated") — this includes historical facts, opening hours, prices, and recommendations. The AI cannot see your surroundings, does not have live data, and cannot verify current local conditions. Independently verify any information that matters to you. The Service does not provide professional, medical, legal, or emergency advice.

6. Your Account

When you first use the app, an anonymous account with free starting credits is created for you automatically. You can optionally register with an email address and password to keep your credits, purchases, and tours across devices. You are responsible for keeping your login credentials confidential and for all activity under your account. Details on how we handle your data are in our Privacy Policy.

7. Credits, Passes, and Prices

Payments are processed by Stripe. We do not receive or store your payment card details. The available payment methods are shown at checkout. Your purchase is complete when the payment is confirmed, and your credits or pass are credited to your account immediately.

9. Right of Withdrawal (Consumers)

If you are a consumer in the EU/EEA, you have the statutory right to withdraw from a purchase within 14 days without giving any reason.

Withdrawal instructions: The withdrawal period is 14 days from the day of purchase. To exercise the right, send us a clear statement (an email to [email protected] is sufficient) before the period expires — stating your purchase and, if possible, the email address of your account. No particular form is required.

Because credits and passes are services that begin immediately after purchase, the following applies:

Refunds are issued to the original payment method within 14 days of your withdrawal. This section does not limit any further statutory rights you may have.

10. Permitted and Prohibited Use

We grant you a limited, non-exclusive, non-transferable right to use the Service for personal, non-commercial purposes. You may not:

11. Intellectual Property

The Service, its design, software, and our content are owned by AIchievable and protected by law. Tours generated for you may be used for your personal purposes. Content you submit (such as questions or photos) remains yours; you grant us the rights needed to process it for operating the Service, as described in the Privacy Policy. If you send us feedback or suggestions, we may use them to improve the Service without obligation to you.

12. Third-Party Services

The Service relies on third-party providers: OpenAI (AI responses and the guide's voice), DeepInfra (speech recognition), OpenRouter (auxiliary AI processing), Mapbox (maps and routes), Stripe (payments), and Supabase (backend infrastructure). Their availability is outside our control, and individual features may be temporarily unavailable if a provider has an outage or discontinues a service.

13. Availability and Warranties

We work to keep the Service available and reliable, but we cannot guarantee uninterrupted, error-free operation, and we may modify or improve features over time. Where you use the Service as a consumer, your statutory warranty rights for digital services remain unaffected by this section.

14. Liability

We are liable without limitation for damage caused intentionally or by gross negligence, and for injury to life, body, or health. For slight negligence, we are liable only for breaches of essential contractual obligations, limited to the foreseeable damage typical for this kind of contract. Any further liability is excluded. This does not affect any liability that cannot be limited under applicable mandatory law, and it does not reverse the burden of proof to your disadvantage.

Remember Section 3: you remain responsible for your own conduct and safety in the real world while using the Service.

15. Termination

You may stop using the Service and request deletion of your account at any time. We may suspend or terminate your access if you materially violate these Terms (for example, abuse, fraud, or circumvention of usage limits); where reasonable, we will warn you first. Your statutory rights, including refund rights for services not provided, remain unaffected.

16. Governing Law and Disputes

These Terms are governed by Swiss law. If you are a consumer, this choice of law does not deprive you of the protection of mandatory provisions of the law of your country of habitual residence, and mandatory rules on jurisdiction in your country remain unaffected.

We are not obligated and not willing to participate in dispute resolution proceedings before a consumer arbitration board.

17. Changes to These Terms

We may update these Terms, for example when features or laws change. The current version is always available on this page, with the "Last Updated" date at the top. For material changes we will provide clear notice within the Service. If you continue to use the Service after changes take effect, the updated Terms apply; changes never retroactively affect purchases you have already made. This version replaces the Terms dated August 9, 2025, which described our former iOS app.
